به گزارش حقوق بشر در ایران، ۳ دی ماه ۱۴۰۲، علی لاله دانی، فرزند: محمود، ساکن استان همدان، زندانی سیاسی، در حال سپری کردن حبس تعزیری ۱۰ ساله خود در زندان مرکزی استان همدان است. این زندانی سیاسی از بابت ۱ پرونده در ۲ بخش، مجموعا به ۱۹ سال و ۴ ماه حبس تعزیری محکوم شده که از میزان ۱۰ سال آن لازم به اجرا است.
به نقل از یک فرد نزدیک به خانواده این زندانی سیاسی در گفتگو با گزارشگر حقوق بشر در ایران:”علی لاله دانی، در حالی که ابتدا توسط قاضی شعبه دادگاه انقلاب همدان پس از اعمال ماده ۱۳۴، به تحمل ۶ سال حبس تعزیری محکوم شده بود اما در پی اعتراض نماینده دادستان، حکم وی توسط قاضی شعبه دادگاه تجدیدنظر استان همدان، به ۱۰ سال حبس لازم به اجرا افزایش پیدا کرد.”
لازم به اشاره است، علی لاله دانی، ابتدا در تاریخ ۲۲ شهریور ماه ۱۳۹۹، توسط قاضی حسین نظری ـ رئیس شعبه اول دادگاه انقلاب استان همدان، از بابت اتهامات تشکیل گروه و جمعیت با نام براندازان مبارزبا هدف برهم زدن امنیت کشور ، فعالیت تبلیغی علیه نظام از طریق شعارنویسی ، توهین به رهبری از طریق شعارنویسی ، تحریق و آتش زدن اموال بانک قوامین ـ شعبه میدان سپاه همدان و بنرهای متعلق به اداره کل تبلیغات اسلامی همدان به منظور مقابله با نظام ، محاکمه و از بابت اتهام اول به تحمل ۶ سال حبس تعزیری، اتهام دوم به تحمل ۱ سال حبس تعزیری، از بابت اتهام سوم به تحمل ۲ سال حبس تعزیری و پرونده برای رسیدگی از بابت اتهام تحریق و آتش زدن اموال بانک قوامین ـ شعبه میدان سپاه همدان و بنرهای متعلق به اداره کل تبلیغات اسلامی همدان به منظور مقابله با نظام به شعبه ۱۰۷ دادگاه کیفری ۲ استان همدان، ارجاع و از بابت اتهام تحریک مردم به خشونت علیه نظام به تحمل ۱ سال حبس تعزیری و از اتهام شروع به ساخت مواد انفجاری ناریه تبرئه شد.
پس از اعلام تسلیم به رای علی لاله دانی، به حکم صادره توسط قاضی شعبه ۱۰۷ دادگاه کیفری۲ استان همدان و اعمال ماده ۴۴۲ قانون آئین دادرسی، با کسر ۲ ماه از حبس تعزیری ۱ ساله اش وی به تحمل ۱۰ ماه حبس تعزیری لازم به اجرا محکوم شد.
اما با توجه به حکمی در شعبه اول دادگاه انقلاب همدان بر علیه علی لاله دانی صادر شده بود در پی اعتراض وی و ارجاع پرونده اش به شعبه ۱۱ دادگاه تجدیدنظر استان همدان، وی در تاریخ ۲۰ دی ماه ۱۳۹۹، توسط قاضی سیدرضا حسنی حلم و مستشار شعبه ـ بهرام کراری، از بابت اتهام فعالیت تبلیغی علیه نظام به تحمل ۸ ماه حبس تعزیری، به اتهام توهین به رهبری به تحمل ۱ سال و ۴ ماه حبس تعزیری و از بابت اتهام تشکیل گروه و جمعیت با نام براندازان مبارز با هدف برهم زدن امنیت کشور به تحمل ۶ سال حبس تعزیری، محکوم شد ولی پس از ابلاغ حکم صادره توسط قاضی شعبه دادگاه تجدیدنظر استان همدان و اعتراض دادستان ـ بعنوان طرف دیگر این پرونده مبنی بر ناکافی بودن میزان حکم صادره، علی لاله دانی، مجددا در ۱۱ دادگاه تجدیدنظر استان همدان، محاکمه و علی لاله دانی، از بابت اتهام فعالیت تبلیغی علیه نظام به تحمل ۱ سال حبس تعزیری، به اتهام توهین به رهبری به تحمل ۲ سال حبس تعزیری و از بابت اتهام تشکیل گروه و جمعیت با نام براندازان مبارزبا هدف برهم زدن امنیت کشور هم به تحمل ۱۰ سال حبس تعزیری و از بابت اتهام تحریک مردم به جنگ و کشتار علی یکدیگر هم به تحمل ۵ سال حبس تعزیری، محکوم شد.
با اعمال ماده ۱۳۴ تجمیع جرائم ، تحمل اشد مجازات یعنی ۱۰ سال حبس تعزیری برای علی لاله دانی لازم به اجرا شده و این فعال مدنی از سال ۱۳۹۹ در حال سپری کردن دوران محکومیت خود در زندان مرکزی همدان، است.
علی لاله دانی، در سال ۱۳۹۸، به اتهام شعارنویسی و فعالیت در فضای مجازی، توسط نیروهای امنیتی در استن همدان، دستگیر و پس از انتقال به بازداشتگاه یکی از نهادهای امنیتی در آن استان و طی مراحل بازجویی ها و تفهیم اتهام، پرونده وی به دادگاه شعبه اول دادگاه انقلاب همدان و بخش دوم از همین پرونده هم به شعبه ۱۰۷ دادگاه کیفری۲ همدان، ارجاع شد.
According to the Human Rights Report in Iran, on December 24, 2023, Ali Laleh Dani, son of Mahmoud, a resident of Hamadan province and a political prisoner, is serving his 10-year discretionary imprisonment in Hamadan Central Prison. This political prisoner has been sentenced to a total of 19 years and 4 months of discretionary imprisonment in two parts of a single case, of which 10 years are enforceable.
According to a person close to the family of this political prisoner in an interview with the Human Rights Reporter in Iran: "Ali Laleh Dani, initially sentenced to 6 years of discretionary imprisonment by the judge of the Revolutionary Court of Hamadan after the application of Article 134, had his sentence increased to 10 years enforceable imprisonment following an appeal by the prosecutor's representative, which was upheld by the judge of the Hamadan Provincial Court of Appeals."
It is worth mentioning that Ali Laleh Dani was initially tried on September 12, 2020, by Judge Hossein Nazari, head of the first branch of the Revolutionary Court of Hamadan Province, on charges of forming a group and assembly under the name of "Revolutionary Overthrowers" with the aim of disrupting national security, engaging in propaganda activities against the regime through graffiti, insulting the leadership through graffiti, arson of properties of Ghavamin Bank – Sepah Square branch in Hamadan, and banners belonging to the Islamic Propaganda Department of Hamadan to counter the regime. He was sentenced to 6 years of discretionary imprisonment for the first charge, 1 year for the second charge, and 2 years for the third charge. The case was referred to Branch 107 of the Criminal Court 2 of Hamadan Province for the charge of arson of the properties of Ghavamin Bank and banners belonging to the Islamic Propaganda Department of Hamadan. He was sentenced to 1 year of discretionary imprisonment for inciting people to violence against the regime and was acquitted of the charge of attempting to manufacture explosive materials.
After Ali Laleh Dani accepted the verdict issued by the judge of Branch 107 of the Criminal Court 2 of Hamadan Province and the application of Article 442 of the Code of Criminal Procedure, his 1-year discretionary imprisonment was reduced by 2 months, resulting in a 10-month enforceable discretionary imprisonment sentence.
However, following a ruling against Ali Laleh Dani in the first branch of the Revolutionary Court of Hamadan and his subsequent appeal, his case was referred to Branch 11 of the Hamadan Provincial Court of Appeals. On January 10, 2021, he was sentenced by Judge Seyed Reza Hasani Helm and advisor Bahram Karari to 8 months of discretionary imprisonment for propaganda activities against the regime, 1 year and 4 months for insulting the leadership, and 6 years for forming a group and assembly under the name of "Revolutionary Overthrowers" with the aim of disrupting national security. However, after the verdict was communicated by the judge of the Hamadan Provincial Court of Appeals and the prosecutor, as the other party in this case, objected to the insufficiency of the sentence, Ali Laleh Dani was retried in the 11th Court of Appeals of Hamadan Province. He was sentenced to 1 year of discretionary imprisonment for propaganda activities against the regime, 2 years for insulting the leadership, 10 years for forming a group and assembly under the name of "Revolutionary Overthrowers" with the aim of disrupting national security, and 5 years for inciting people to war and massacre against each other.
With the application of Article 134 regarding the aggregation of crimes, the most severe punishment, which is 10 years of discretionary imprisonment, was enforced for Ali Laleh Dani, and this civil activist has been serving his sentence in Hamadan Central Prison since 2020.
In 2019, Ali Laleh Dani was arrested by security forces in Hamadan on charges of graffiti and online activities. After being transferred to a detention center of one of the security agencies in the province and undergoing interrogation and indictment, his case was referred to the first branch of the Revolutionary Court of Hamadan, and the second part of the same case was referred to Branch 107 of the Criminal Court 2 of Hamadan.
