Although in early June 2023, it was reported that the sentence of three executions for Javad Rouhi, one of the detainees from last year's protests, had been overturned, Majid Kaveh, his lawyer, reports uncertainty regarding this prisoner's situation and disregard for the Supreme Court's ruling.
The detailed account of the sentences issued by Branch One of the Sari Court, as narrated by Javad Rouhi's lawyer, includes eight convictions, three executions, and seven and a half years in prison as follows:
- "One execution for corruption on earth and waging war against God through committing crimes against internal security."
- "One execution for arson and destruction of property and setting fire to public places like the municipality, governor's office, bank, police headquarters, and vehicle to disrupt public order and security and oppose the Islamic government, subject to Note 1 of Article 687 of the Islamic Penal Code."
- "Another execution for apostasy and being subject to execution for insulting sacred values by desecrating the Quran through burning, subject to Article 513 of the Islamic Penal Code."
- "Two years of discretionary imprisonment for inciting and provoking people to war and killing each other with the intent to disrupt national security, subject to Article 512 of the Islamic Penal Code."
- "Six months of discretionary imprisonment for propaganda activities against the regime, subject to Article 500 of the Islamic Penal Code."
- "Four years of discretionary imprisonment for gathering and colluding to commit crimes against internal security, subject to Article 610 of the Islamic Penal Code."
- "One year of discretionary imprisonment for insulting the leadership, subject to Article 514 of the Islamic Penal Code."
In an interview with Shargh, the lawyer said: "After filing the appeal in winter 2023, Javad Rouhi's case was finally reviewed in late spring 2023 by Branch Nine of the Supreme Court, which ultimately led to the overturning of the three execution sentences for Javad Rouhi."
Majid Kaveh, regarding the status of the case after the ruling was overturned, says: "Following the referral of the case to the judiciary of Sari County and considering the dissolution of the special branch dealing with these crimes in the Revolutionary Court of the provincial capital due to the expiration of its mission term, the case was assigned in June 2023 for consideration in a parallel branch at the Revolutionary Court of Tonekabon County. However, that court did not consider itself competent as a parallel branch to Branch One of the Sari Revolutionary Court and referred the case to Branch One of the Amol Revolutionary Court, which also, citing its lack of jurisdiction, sent the case back to Branch One of the Sari Revolutionary Court."
He adds: "This issue has caused numerous physical and mental problems for my client and his family."
اگرچه در اوایل خردادماه امسال خبر رسید که حکم سه بار اعدام جواد روحی، از بازداشت شدگان اعتراضات سال گذشته، نقض شده است، اما مجید کاوه، وکیل او، از بلاتکلیفی این زندانی و بی توجهی به رأی دیوان خبر می دهد.
روایت دقیق احکام صادرشده شعبه یک دادگاه ساری به روایت وکیل جواد روحی شامل هشت مورد محکومیت، سه اعدام و هفت سال و نیم زندان به شرح زیر است:
«یک بار اعدام به اتهام افساد فى الارض و محاربه از طریق ارتکاب جرم علیه امنیت داخلى.»
«یک بار اعدام به اتهام احراق و تخریب اموال و آتش زدن اماکن عمومى مانند شهردارى، فرماندارى، بانک، مقر و خودروی انتظامى به منظور اخلال در نظم و امنیت جامعه و مقابله با حکومت اسلامى موضوع تبصره ١ ماده ٦٨٧ قانون مجازات اسلامى».
«اعدام دیگر به اتهام ارتداد و مهدورالدم بودن به اتهام توهین به مقدسات به واسطه هتک حرمت به قرآن کریم از طریق آتش زدن موضوع ماده ٥١٣ قانون مجازات اسلامى».
« تحمل دو سال حبس تعزیرى به اتهام اغوا و تحریک مردم به جنگ و کشتار با یکدیگر به قصد برهم زدن امنیت کشور موضوع ماده ٥١٢ قانون مجازات اسلامى».
«تحمل شش ماه حبس تعزیرى به اتهام فعالیت تبلیغى علیه نظام موضوع ماده ٥٠٠ قانون مجازات اسلامى».
«تحمل چهار سال حبس تعزیرى به اتهام اجتماع و تبانى براى ارتکاب جرم بر ضد امنیت داخلى کشور موضوع ماده ٦١٠ قانون مجازات اسلامى».
«تحمل یک سال حبس تعزیرى به اتهام اهانت به رهبرى موضوع ماده ٥١٤ قانون مجازات اسلامى»
این وکیل در گفتگو با شرق گفت: «پس از ثبت فرجام خواهی در زمستان ۱۴۰۱ نهایتا در اواخر بهار ۱۴۰۲ پرونده جواد روحی در شعبه نهم دیوان عالی کشور بررسی شد و نهایتا منجر به نقض حکم سه بار اعدام جواد روحی شد.»
مجید کاوه، درباره وضعیت پرونده بعد از نقض حکم می گوید: پس از ارجاع پرونده به دادگسترى شهرستان سارى و با توجه به انحلال شعبه ویژه رسیدگى به این جرائم در دادگاه انقلاب مرکز استان با انقضای مهلت مأموریت آن، پرونده در خرداد ماه سال جارى جهت رسیدگى در شعبه هم عرض، به دادگاه انقلاب شهرستان تنکابن محول شد؛ اما آن دادگاه خود را به عنوان دادگاه هم عرض شعبه یک دادگاه انقلاب سارى صالح به رسیدگى ندانسته و پرونده را به شعبه یک دادگاه انقلاب شهرستان آمل ارجاع داده که دادگاه مزبور نیز با نظر به صلاحیت نداشتن خود براى رسیدگى به پرونده مجددا پرونده را به شعبه اول دادگاه انقلاب سارى ارسال کرده است.»
او اضافه می کند: «این موضوع باعث بروز مشکلات عدیده جسمى و روحى براى موکل و خانواده او شده است.»
