According to Human Rights in Iran, today, Thursday, December 7, 2023, Shakila Monfared, a constitutionalist political activist and political prisoner held in Evin Prison, is awaiting notification of her court hearing date from Branch 26 of the Tehran Revolutionary Court. Shakila Monfared is serving a five-year prison sentence for blasphemy.
A person close to Shakila Monfared's family told Human Rights in Iran: "On Wednesday, December 6, 2023, the indictment against Shakila Monfared was referred to Branch 26 of the Tehran Revolutionary Court. The charge presented to this political prisoner, as stated in the indictment, is propaganda against the regime, under Article 500 of the Islamic Penal Code. However, it is mentioned in the indictment that due to political and security conditions, if a verdict of conviction is issued, it is recommended that the sentence be carried out outside the city of Tehran."
It is noteworthy that in a case opened against her inside the prison on February 9, 2022, Shakila Monfared was sentenced by Branch 26 of the Tehran Revolutionary Court for spreading falsehoods to a fine of 10 million tomans and for membership in opposition groups. This verdict was confirmed on May 31, 2022. Considering Shakila Monfared's new conviction in this case, the total mandatory prison sentence for this political prisoner, applying Article 134 of the Islamic Penal Code, is five years.
Shakila Monfared was arrested on January 20, 2021, after a court session at Branch 26 of the Tehran Revolutionary Court, presided over by Iman Afshari, and transferred to prison. On January 24, 2021, she was sentenced by the mentioned branch to one year of imprisonment for propaganda against the regime and five years for blasphemy.
Regarding the case for which Shakila Monfared is serving a five-year prison sentence, a knowledgeable source previously explained to Human Rights in Iran: "This case involves three defendants: Arsham Rezaei as the first defendant, Shakila Monfared as the second defendant, and Mohammad Abolhasani as the third defendant. They were interrogated and charged at Branch 2 of the Evin Prison Prosecutor's Office, presided over by Haj Moradi and Amin Naseri, the Deputy Prosecutor General and Revolutionary of Tehran. The case agent is the Intelligence Organization of the Islamic Revolutionary Guard Corps. According to the indictment, Mahmoud 'Arsham' Rezaei was active on his personal Twitter and Instagram accounts in overthrowing the regime and supporting monarchists. Through the third defendant, Mohammad Abolhasani, he published information related to political and ideological prisoners in Evin Prison on social media. Arsham Rezaei was also in contact with Soheila Hejab, a political prisoner in Qarchak Varamin Prison, and disseminated audio files and related news outside Qarchak Varamin Prison, maintaining contact with other political prisoners and publishing news about Greater Tehran Prison on social media. Mohammad Abolhasani is charged with 'propaganda against the regime.' Arsham Rezaei faces charges of 'propaganda against the Islamic Republic regime' and 'assembly and collusion to commit crimes against national and international security.'"
Regarding Shakila Monfared's charges, another defendant in this case, the informed source stated: "Ms. Monfared's charges relate to her activities on her personal Twitter page. According to the indictment, this media activist started a Twitter account under her name in 2018 after being released from prison, gaining 14,000 followers, and engaging in propaganda against the regime by publishing news about political prisoners. Shakila Monfared is also accused of collaborating and communicating with foreign television networks, sending them news and information about political prisoners. Another charge against her is contacting Soheila Hejab, a political prisoner, and sending her news and audio files to media and individuals outside Iran."
This civil activist is also accused of consistently publishing content in support of political prisoners, including Samaneh Norooz Moradi and Reza Mohammadhosseini, widely on her Twitter account. Another charge against her involves insulting religious sanctities, the leadership, and Ruhollah Khomeini during the Muharram ceremonies. Shakila Monfared's charges include propaganda against the Islamic Republic regime, assembly and collusion to commit crimes against national and international security, blasphemy, and insults to Khomeini and the leadership.
In January 2021, following a telephone summons to the Evin Prison Prosecutor's Office, Shakila Monfared faced new charges and an increased bail amount. After posting the new judicial bond, she was temporarily released.
This civil activist was arrested on August 31, 2020, by security forces while leaving her home. After being transferred to solitary confinement and undergoing interrogation and charges on September 9, 2020, she was moved to the women's ward of Evin Prison and released on bail on September 15, 2020.
به گزارش حقوق بشر در ایران، امروز پنجشنبه ۱۶ آذر ماه ۱۴۰۲، شکیلا منفرد، فعال سیاسی مشروطه خواه و زندانی سیاسی محبوس در زندان اوین، در انتظار ابلاغ تاریخ دادرسی به پرونده قضایی خود توسط شعبه ۲۶ دادگاه انقلاب تهران، است. شکیلا منفرد، در حال سپری کردن دوران حبس تعزیری ۵ ساله خود به اتهام توهین به مقدسات است.
به نقل از یک فرد نزدیک به خانواده شکیلا منفرد در گفتگو با گزارشگر حقوق بشر در ایران:”روز چهارشنبه ۱۵ آذر ماه ۱۴۰۲، کیفرخواست صادره بر علیه شکیلا منفرد به شعبه ۲۶ دادگاه انقلاب تهران ارجاع شد و اتهام تفهیم شده به این زندانی سیاسی و مندرج در کیفرخواست صادره فعالیت تبلیغی علیه نظام ، موضوع ماده ۵۰۰ قانون مجازات اسلامی، است اما در این کیفرخواست عنوان شده با توجه به شرایط سیاسی و امنیتی، در صورت صدور رای مبنی بر محکومیت نامبرده، پیشنهاد می گردد اجرای حکم ایشان خارج از شهر تهران صورت گیرد .”
لازم به ذکر است، شکیلا منفرد، در پرونده ای که داخل زندان برای وی باز شده بود به تاریخ ۲۰ بهمن ماه ۱۴۰۰، توسط شعبه ۲۶ دادگاه انقلاب تهران، به اتهام نشر اکاذیب به پرداخت ۱۰ میلیون تومان جریمه نقدی و به اتهام عضویت در گروههای معاند نظام محکوم شد و این حکم در تاریخ ۱۰ خرداد ماه ۱۴۰۱، عینا تائید شد. با توجه به محکومیت جدید شکیلا منفرد در این پرونده مجموع حبس تعزیری لازم به اجرای این زندانی سیاسی با اعمال ماده ۱۳۴ از قانون مجازات اسلامی ۵ سال حبس تعزیری است.
شکیلا منفرد، در تاریخ ۱بهمن ماه ۱۳۹۹، پس تشکیل جلسه دادرسی در شعبه ۲۶ دادگاه انقلاب تهران به ریاست ایمان افشاری بازداشت و به زندان منتقل شد و در تاریخ ۵ بهمن ماه ۱۳۹۹، با صدور دادنامه ای توسط شعبه مذکور به اتهام تبلیغ علیه نظام به تحمل ۱ سال حبس تعزیری و به اتهام توهین به مقدسات اسلامی هم به تحمل ۵ سال حبس تعزیری محکوم شد.
در خصوص پرونده ای که شکیلا منفرد درحال سپری کردن دوران محکومیت حبس تعزیری ۵ ساله آن هست پیشتر یک منبع مطلع در تشریح آن به حقوق بشر در ایران گفته بود: “این پرونده دارای ۳ متهم است که به ترتیب آرشام رضائی – بعنوان متهم ردیف اول، شکیلا منفرد – متهم ردیف دوم و محمد ابوالحسنی هم بعنوان متهم ردیف سوم، در شعبه ۲ بازپرسی دادسرای زندان اوین به ریاست حاج مرادی و همچنین امین ناصری، معاون دادستان عمومی و انقلاب تهران مورد بازپرسی و تفهیم اتهام قرار گرفتند. ضابط این پرونده سازمان اطلاعات سپاه پاسداران است. در این پرونده با توجه به کیفرخواست صادره آمده است که محمود « آرشام » رضائی در توئیتر و اینستاگرام شخصی خود در جهت براندازی نظام و حمایت از سلطنت طلبان فعالیت می کرده و از طریق متهم ردیف سوم این پرونده یعنی محمد ابوالحسنی، اخبار مرتبط با زندانیان سیاسی و عقیدتی زندان اوین را در فضای مجازی منتشر می کرده است. همچنین آرشام رضائی به ارتباط با سهیلا حجاب، زندانی سیاسی در زندان قرچک ورامین و انتشار فایلهای صوتی و اخبار مرتبط با وی به خارج از زندان قرچک ورامین اقدام می کرده و با زندانیان سیاسی دیگر در ارتباط بوده و اخبار زندان تهران بزرگ را هم در فضای مجازی منتشر می کرده است. اتهام محمدابوالحسنی در این پرونده « فعالیت تبلیغی علیه نظام » عنوان شده است. همچنین آرشام رضائی با اتهامات « فعالیت تبلیغی علیه نظام جمهوری اسلامی »، « اجتماع و تبانی برای ارتکاب جرم بر ضد امنیت داخلی و خارجی کشور » مورد تفهیم اتهام قرار گرفته است.”
این منبع مطلع در خصوص اتهامات شکیلا منفرد، دیگر متهم این پرونده گفته بود: “اتهامات خانم منفرد، مرتبط با فعالیتهای وی در صفحه توئیتر شخصی اش بوده و براساس کیفرخواست صادره این فعال رسانه ای در سال ۱۳۹۷ پس از آزادی از زندان حساب توئیتری با نام خودش راه اندازی کرده و دارای ۱۴ هزار ممبر هم بوده و با انتشار اخبار زندانیان سیاسی فعالیت تبلیغی علیه نظام می کرده است. همچنین شکیلا منفرد متهم به همکاری و ارتباط با شبکه های تلوزیونی خارج از ایران شده و برای آنها اخبار و مطالب از زندانیان سیاسی را ارسال می کرده است. دیگر اتهام شکیلا منفرد ارتباط گیری با سهیلا حجاب، زندانی سیاسی، بوده و اخبار و فایلهای صوتی این زندانی سیاسی را برای رسانه ها و افراد خارج از ایران ارسال می کرده است.
این فعال مدنی همچنین متهم شده که به صورت مداوم مطالبی در حمایت از زندانیان سیاسی از جمله سمانه نوروزمرادی و رضا محمدحسینی، بصورت گسترده در توئیتر خود منتشر کرده بود و در دیگر اتهام هم در جریان مراسم محرم به مقدسات و توهین به رهبری و توهین روح الله خمینی متهم شده است. اتهامات شکیلا منفرد عبارتند از: فعالیت تبلیغی علیه نظام جمهوری اسلامی ، اجتماع و تبانی برای ارتکاب جرم بر ضد امنیت داخلی و خارجی کشور ، توهین به مقدسات اسلامی ، توهین به خمینی و توهین به رهبری .
شکیلا منفرد، در دی ماه سال ۱۳۹۹، با توجه به احضار تلفنی به شعبه بازپرسی دادسرای زندان اوین و تغییر و افزایش عناوین اتهامی و مبلغ وثیقه صادره مورد تفهیم اتهام بازپرسی با اتهامات جدید قرار گرفت و پس از تودیع قرار قضائی جدید بطور موقت آزاد شده بود.
این فعال مدنی، در تاریخ ۱۰ شهریور ماه ۱۳۹۹، هنگام خروج از منزل، توسط نیروهای امنیتی بازداشت و پس از انتقال به سلول انفرادی و پس از طی مراحل بازجوئی و تفهیم اتهام در تاریخ ۱۹ شهریور ماه ۱۳۹۹، به بند زنان زندان اوین منتقل و در تاریخ ۲۵ شهریور ماه ۱۳۹۹، با تودیع وثیقه آزاد شده بود.
