On Saturday, February 3, 2024, Mohammadvali Heidarbeigi, son of Mohammadhossein, a civil activist residing in Abhar County, Zanjan Province, a chemical warfare veteran with nerve and psychological injuries and disabilities from the 8-year Iran-Iraq war, was acquitted of the charges against him by the judge and advisor of Branch 11 of the Zanjan Province Court of Appeal.
According to the issued verdict obtained by Human Rights in Iran, Mohammadvali Heidarbeigi was acquitted by Judge Taremi and Advisor Ali Khan Mohammadi of charges for which he had previously been sentenced to imprisonment and a monetary fine, and a decision to drop the charges was issued.
It is worth mentioning that on January 24, 2024, Mohammadvali Heidarbeigi was tried by Judge Taremi and Advisor Ali Khan Mohammadi in Branch 11 of the Zanjan Province Court of Appeal on charges of membership in opposition groups, collaboration with hostile foreign governments against the Islamic Republic through individuals based in the USA and UK, insulting the leadership in cyberspace, possession of narcotics, propaganda against the regime in cyberspace, and assembly and collusion to commit crimes against national security.
On January 7, 2024, Mohammadvali Heidarbeigi was tried by Judge Ghasem Karami and Advisor Asadollah Ganj Khanlou in Branch 1 of the Zanjan Province Criminal Court 1 on charges of financing terrorism, possession of illegal weapons and ammunition, possession of a stun gun, disobedience to government officials, and spreading falsehoods in cyberspace. On January 9, 2024, he was sentenced to a total of 2 years and 3 months of discretionary imprisonment of degrees 5 and 7, and also to pay three fines of degree 7 amounting to 30 million Rials. He was acquitted of the charges of financing terrorism, spreading falsehoods in cyberspace, and disobedience to officials during duty, and a decision to drop these charges was issued.
The first court session for this case was held on November 14, 2023, by Judge Karami, head of Branch 1 of the Zanjan Criminal Court 1, with the assistance of Advisor Asadollah Ganj Khanlou. Mohammadvali Heidarbeigi presented part of his defense regarding the charge of spreading falsehoods in cyberspace with the intent to disturb public opinion. However, in early December 2023, he was summoned to the aforementioned branch for the continuation of the trial session.
On October 2, 2023, in the first part of this case, Mohammadvali Heidarbeigi was sentenced by Judge Abolfazl Ashari of the Revolutionary Court of Abhar to 5 years of discretionary imprisonment for collaboration with a hostile government, 1 year for propaganda activities against the regime, 5 years for assembly and collusion against national security and membership in opposition groups, and 2 years for insulting the leadership.
In mid-September 2023, he received two separate written summonses for trial in Branch 1 of the Zanjan Revolutionary Court 1 and Branch 103 of the Abhar County Criminal Court 2. On October 1, 2023, he was tried by Judge Abolfazl Ashari, head of Branch 103 of the Abhar Criminal Court 2 and the Revolutionary Court of that county. Due to physical health issues, he was unable to attend that trial session, but Ali Masgari, the defense attorney for this case, presented his defense to the court judge.
This resident of Abhar County, who lost both legs below the knee in the 8-year Iran-Iraq war, was arrested on November 19, 2022, while driving his car on the street following an attack by 9 officers from the Zanjan Province Intelligence Department. After undergoing interrogation and being informed of the charges, he was transferred to the security ward of Safarabad Prison in Zanjan Province. Following a prolonged hunger strike and medication refusal, he was released on bail of 10 billion Rials on December 14, 2022, until the completion of the legal proceedings.
به گزارش حقوق بشر در ایران، روز شنبه ۱۴ بهمن ماه ۱۴۰۲، محمدولی حیدربیگی، فرزند: محمدحسین، فعال مدنی، ساکن شهرستان ابهر از توابع استان زنجان، جانباز شیمیایی، اعصاب ـ روان و نقص عضو در جنگ ۸ ساله ایران و عراق، توسط قاضی و مسشتار شعبه ۱۱ دادگاه تجدیدنظر استان زنجان، از اتهامات منتسبه تبرئه شد.
براساس دادنامه صادره که در اختیار حقوق بشر در ایران قرار گرفته، محمدولی حیدربیگی، توسط قاضی طارمی و مستشار علی خان محمدی، از بابت اتهانتی که پیشتر به حبس تعزیری و پرداخت جریمه نقدی، محکوم شده بود تبرئه و قرار منع تعقیب وی صادر شد.
لازم به اشاره است، محمدولی حیدربیگی، در تاریخ ۴ بهمن ماه ۱۴۰۲، توسط قاضی طارمی و مستشار علی خان محمدی ـ در شعبه ۱۱ دادگاه تجدیدنظر استان زنجان، ازبابت اتهامات عضویت در جمعیتهای معارض کشور ، همکاری با دووَل خارجی متخاصم علیه نظام جمهوری اسلامی از طیق افراد مستقر در آمریکا و انگلیس ، توهین به رهبری در فضای مجازی ، نگهداری موادمخدر ، تبلیغ علیه نظام در فضای مجازی ، اجتماع و تبانی برای ارتکاب جرم علیه امنیت ملی محاکمه شده بود.
محمدولی حیدربیگی، در تاریخ ۱۷ دی ماه ۱۴۰۲، توسط قاضی قاسم کرمی و اسدالله گنج خانلو ـ مستشار ـ شعبه اول دادگاه کیفری ۱ استان زنجان، از بابت اتهامات تامین مالی تروریسم، نگهداری سلاح و مهمات غیرمجاز، نگهداری شوکر ، تمرد از دستور ماموران دولتی ، نشر اکاذیب در فضای مجازی محاکمه و در تاریخ ۱۹ دی ماه ۱۴۰۲، در مجموع به تحمل ۲ سال و ۳ ماه حبس تعزیری درجه ۵ و ۷ و همچنین به پرداخت ۳ فقره جریمه نقدی درجه ۷ به میزان ۳۰ میلیون ریال محکوم و از اتهامات حمایت مالی تروریسم ، نشر اکاذیب در فضای مجازی و تمرد از دستور ماموران هنگام انجام وظیفه تبرئه و نسبت به این ۳ اتهام قرار منع تعقیب وی صادر شده بود.
جلسه اول دادگاه رسیدگی به این پرونده در تاریخ ۲۳ آبان ماه ۱۴۰۲، توسط قاضی کرمی ـ رئیس شعبه ۱ دادگاه کیفری یک زنجان با همراهی اسدالله گنج خانلو ـ مستشار شعبه مذکور، برگزار و محمدولی حیدربیگی، بخشی از دفاعیات خود را از بابت اتهام نشر اکاذیب در فضای مجازی به قصد تشویش اذهان عمومی ارائه کرده بود اما اوایل دی ماه ۱۴۰۲، برای ادامه جلسه دادرسی به شعبه مذکور احضار شده بود.
محمدولی حیدربیگی، در تاریخ ۱۰ مهر ماه ۱۴۰۲، در بخش اول از همین پرونده نیز، توسط قاضی ابوالفضل عاشری دادرس شعبه دادگاه انقلاب ابهر ، از بابت اتهام همکاری با دولت متخاصم به تحمل ۵ سال حبس تعزیری، به اتهام فعالیت تبلیغی علیه نظام به تحمل ۱ سال حبس تعزیری، از بابت اتهام اجتماع و تبانی علیه امنیت ملی و عضویت در گروه های مخالف نظام به تحمل ۵ سال حبس تعزیری و به اتهام توهین به رهبری هم به تحمل ۲ سال حبس تعزیری محکوم شده بود.
وی، اواسط شهریور ماه ۱۴۰۲، با دریافت ۲ ابلاغیه کتبی جداگانه برای محاکمه به شعبه ۱ دادگاه کیفری انقلاب ۱ زنجان و شعبه ۱۰۳ دادگاه کیفری ۲ شهرستان ابهر، احضار شد و در تاریخ ۹ مهر ماه ۱۴۰۲، توسط قاضی ابوالفضل عاشری، رئیس شعبه ۱۰۳ دادگاه کیفری۲ ابهر و دادرس دادگاه انقلاب آن شهرستان، محاکمه و با توجه به مشکلات جسمانی قادر به حضور در آن جلسه دادرسی نبود ولی علی مسگری، وکیل مدافع متهم این پرونده دفاعیات خود را به قاضی دادگاه ارائه کرده بود.
این شهروند ساکن شهرستان ابهر، که ۲ پای خود را در جنگ ۸ ساله ایران و عراق از ناحیه زانو به پائین کاملا از دست داده، در تاریخ ۲۸ آبان ماه ۱۴۰۱، در حالی که مشغول تردد با خدروی خود در خیابان بود در پی یورش ۹ تن از ماموران اداره کل اطلاعات استان زنجان، دستگیر و پس از طی مراحل بازجویی ها و تفهیم اتهام، به بند امنیتی زندان سفرآباد استان زنجان، منتقل و در پی اعتصاب غذا و داروی طولانی مدت، در تاریخ ۲۳ آذر ماه ۱۴۰۱، با تودیع وثیقه ای به مبلغ ۱ میلیارد تومان تا اتمام مراحل دادرسی آزاد شده بود.
