Previously, a person had been sentenced to five years of imprisonment by the Revolutionary Court of Oshnavieh on charges of collaborating with the Democratic Party of Iranian Kurdistan.
On 24 January 2026, Ahad Mihan-Khah was arrested by government forces without a judicial warrant. After approximately one month of temporary detention, he was released on bail pending the issuance of a final verdict. During his detention and interrogation, he was denied access to legal counsel and contact or visits with his family.

احد میهن خواه روز شنبه۴ بهمن ۱۴۰۴ ( ۲۴ ژانویه ۲۰۲۶) بدون ارائه حکم قضایی توسط نیروهای حکومتی بازداشت و پس از حدود یک ماه بازداشت موقت، با تودیع وثیقه تا زمان صدور حکم نهایی آزاد شده بود.
وی در تمام دوران بازداشت و بازجویی از حق دسترسی به وکیل و تماس یا ملاقات با خانواده محروم بوده است.
