On Tuesday, July 29, 2025, Mohammad Younesi, the son of Ali Akbar, a resident of Dehloran County in Ilam Province and an Instagram activist, was sentenced by Behnam Tirafkan, a judge at Branch 2 of the Revolutionary Court of Ilam, to a total of 4 years and 3 months of imprisonment. This social media activist had previously been sentenced in his first legal case to an alternative punishment to imprisonment and a monetary fine.
Based on the issued verdict, Mohammad Younesi was sentenced to 3 years and 8 months of imprisonment for the charge of "propaganda activities in favor of or strengthening the Zionist regime" and to 7 months of imprisonment for the charge of "propaganda activities against the regime on social media."
A knowledgeable individual told a human rights reporter in Iran, "He has appealed the issued verdict and is awaiting the final decision of the appeals court."
It is worth noting that Mohammad Younesi was arrested by Ministry of Intelligence agents at his home on July 1, 2025, and after a house search and the confiscation of some items, including his mobile phone, he was transferred to the detention center of the General Directorate of Intelligence of Ilam Province and then to the central prison of Ilam.
After the completion of interrogation and the formal charging process, Ali Younesi was released on July 11, 2025, on bail worth 7 billion tomans.
Mohammad Younesi was first arrested on November 2, 2022, by security forces in Ilam Province. After being transferred to a detention center of one of the security agencies and undergoing interrogation and investigation, he was released on bail a short while later.
With the commencement of the judicial process, he was tried by Branch 2 of the Revolutionary Court of Ilam Province and, on November 27, 2022, was sentenced to 1 year of imprisonment for the charge of "propaganda activities against the regime on social media" and 6 months of imprisonment for the charge of "insulting the leadership on social media." Considering Mohammad Younesi's lack of a criminal record, under Articles 37 and 38 of the Islamic Penal Code amended in 2020, his 1-year imprisonment sentence was reduced to 3 months with a 2-degree reduction.
Additionally, it was stated in the continuation of that verdict, "Considering the special circumstances of the defendant in this case and the application of the added note to Article 37 of the Islamic Penal Code and Articles 64 and 67 of this law," Mohammad Younesi was ultimately sentenced to pay a fine of 70 million rials instead of 3 months of imprisonment, and the 6-month imprisonment sentence for the charge of "insulting the leadership on social media" was reduced to 30 days of imprisonment. With the application of Article 37 of the Islamic Penal Code and Articles 64 and 67 of this law, he was sentenced to pay a fine of 50 million rials.

به گزارش حقوق بشر در ایران، روز سه شنبه ۷ مرداد ماه ۱۴۰۴، محمد یونسی، فرزند: علی اکبر، ساکن شهرستان دهلران از توابع استان ایلام و فعال فضای مجازی«اینستاگرام»، توسط بهنام تیرافکن ـ دادرس شعبه ۲دادگاه انقلاب ایلام، در مجموع به تحمل ۴ سال و ۳ ماه حبس تعزیری محکوم شد. این فعال فضای مجازی، پیشتر هم در پرونده قضایی اول خود به مجازات بدل از حبس تعزیری و پرداخت جزای نقدی محکوم شده بود.
براساس دادنامه صادره محمد یونسی، از بابت اتهام «فعالیت تبلیغی در جهت تائید یا تقویت رژیم صهیونیستی» به تحمل ۳سال و ۸ ماه حبس تعزیری و به اتهام «فعالیت تبلیغی علیه نظام در فضای مجازی» هم به تحمل ۷ ماه حبس تعزیری، محکوم شده است.
به نقل از یک فرد مطلع در گفتگو با گزارشگر حقوق بشر در ایران:” وی به حکم صادره اعتراض کرده و در انتظار رای نهایی دادگاه تجدیدنظر است.”
لازم به ذکر است، محمد یونسی، در تاریخ ۱۰ تیر ماه ۱۴۰۴، توسط ماموران وزارت اطلاعات، در منزل شخصی خود، دستگیر و پس از تفتیش منزل و توقیف برخی لوازم از قبیل گوشی تلفن همراه اش به بازداشتگاه اداره کل اطلاعات استان ایلام، منتقل و سپس به زندان مرکزی ایلام منتقل شد.
پس از اتمام مراحل بازجویی ها و تفهیم اتهام، علی یونسی، در تاریخ ۲۰ تیر ماه ۱۴۰۴، با تودیع قرار وثیقه ای به ارزش ۷ میلیارد تومان، آزاد شد.
محمد یونسی، نخستین مرتبه در تاریخ ۱۱ آبان ماه ۱۴۰۱، توسط نیروهای امنیتی در استان ایلام بازداشت و پس از انتقال به بازداشتگاه یکی از ارگانهای امنیتی و طی مراحل بازجوئی و بازپرسی چندی بعد با تودیع وثیقه آزاد شده بود.
با آغاز مراحل دادرسی، توسط شعبه ۲ دادگاه انقلاب استان ایلام محاکمه و در تاریخ ۶ آذر ماه ۱۴۰۱، از بابت اتهام«فعالیت تبلیغی علیه نظام در فضای مجازی» به تحمل ۱ سال حبس تعزیری، به اتهام «توهین به رهبری در فضای مجازی» هم به تحمل ۶ ماه حبس تعزیری محکوم شده بود و با توجه به فقدان سابقه کیفری محمد یونسی، با اعمال ماده ۳۷ و ۳۸ قانون مجازات اسلامی اصلاحیه سال ۱۳۹۹، مجازات ۱ سال حبس تعزیری وی با ۲ درجه تخفیف به ۳ ماه حبس تعزیری تقلیل پیدا کرده بود.
همچنین، در ادامه آن دادنامه عنوان شده بود«با توجه به وضعیت خاص متهم این پرونده و اعمال تبصره الحاقی ماده ۳۷ قانون مجازات اسلامی و مفاد ۶۴ و ۶۷ این قانون»، در نهایت محمد یونسی به پرداخت ۷۰ میلیون ریال جزای نقدی بدل از ۳ ماه حبس تعزیری و مجازات ۶ ماه حبس تعزیری صادره از بابت اتهام «توهین به رهبری در فضای مجازی» به ۳۰ روز حبس تعزیری و با اعمال ماده ۳۷ قانون مجازات اسلامی و مفاد ۶۴ و ۶۷ این قانون به پرداخت ۵۰ میلیون ریال جزای نقدی محکوم شده بود.
