On June 3, 2023, Esmail Khodayari was summoned to an interrogation session at the prosecutor's office in Qazvin Province. In recent days, Esmail Khodayari, an educator (English teacher) residing in Khorramdasht, a district in Qazvin Province, was summoned to the Qazvin Province Public and Revolutionary Prosecutor's Office.
The exact reason for the summons and the legal basis for the charges against Esmail Khodayari are not known, but it appears that the summons is related to a case for which he was arrested in October 2022.
Previously, Esmail Khodayari was convicted by the initial board for administrative violations in the Education Department of Qazvin Province on charges of "propaganda activities against the regime" and was sentenced to "early retirement with a reduction in rank."
It is noteworthy that on October 16, 2022, Esmail Khodayari was arrested after being summoned by phone to one of the security agencies in Qazvin Province. He was detained with a 30-day detention order and was released on November 7, 2022, after completing interrogations and being formally charged, upon posting bail of 200 million tomans.

شنبه ۱۳خرداد ماه ۱۴۰۲، اسماعیل خدایاری به جلسه بازپرسی در دادسرای استان قزوین احضار شد.
به گزارش حقوق بشر در ایران به نقل از شورای هماهنگی تشکلهای صنفی فرهنگیان کشور، طی روزهای اخیر، اسماعیل خدایاری، فرهنگی (دبیر زبان انگلیسی) ساکن شهرستان خردمدشت از توابع استان قزوین، به دادسرای عمومی و انقلاب استان قزوین احضار شد.
براساس این گزارش، از علت دقیق احضار و مصداق حقوقی اتهامی که منجر به احضار اسماعیل خدایاری شده اطلاعی در دسترس نیست اما به نظر می رسد احضار وی مرتبط با پرونده ای که در مهر ماه ۱۴۰۱ بازداشت شده بود صورت گرفته باشد.
اسماعیل خدایاری، پیش از این هم به اتهام (فعالیت تبلیغی علیه نظام)، از سوی هیات بدوی رسیدگی به تخلفات اداری آموزش و پروش استان قزوین، به (بازنشستگی پیش از موعد با تقلیل یک گروه) محکوم شده بود.
لازم به ذکر است، اسماعیل خدایاری، در تاریخ ۲۴ مهر ماه ۱۴۰۱، پس از احضار تلفنی به یکی از ارگانهای امنیتی استان قزوین، بازداشت و با صدور قراربازداشت ۳۰ روز روانه بازداشتگاه شد و در تاریخ ۱۶ آبان ماه ۱۴۰۱، پس از اتمام بازجوئی ها و تفهیم اتهام با تودیع وثیقه ای به مبلغ ۲۰۰ میلیون تومان آزاد شد.
