The five-year prison sentence for Pouria Aliyari, a student of safety engineering at the Esfarayen Technical and Engineering Higher Education Complex, has been upheld by the appeals court. Reports indicate that the student is currently in Turkey after leaving the country and is concerned about being returned to Iran.
According to the appeals verdict, the first branch of the Revolutionary Court of Bojnord, in a judgment dated 2 April 2026, had sentenced Aliyari to five years of imprisonment for "inciting and encouraging others against the internal security of the country in cyberspace" and to one year for "propaganda activities against the Islamic Republic system." The appeals court rejected the request to overturn the sentence and confirmed Aliyari's five-year imprisonment. His initial total sentence of six years was reduced to five years after the appeals process, and this decision has been declared final.
The court based its reasoning on reports from security officers, Aliyari's presence at protest sites, his filming activities, and the content of his mobile phone. His objection regarding the change of charge title compared to the indictment was dismissed with the argument that aligning the charge title with the attributed act is within the court's discretion.
Reports show that Aliyari was arrested on 3 January 2026 in Esfarayen while filming security forces' violence and subsequently had to leave Iran. It has also been announced that the French Embassy has invited Aliyari for an interview, but his visa has not yet been issued. Concerns about deportation from Turkey and being returned to Iran remain.
حکم پنج سال حبس پوریا علی یاری، دانشجوی مهندسی ایمنی مجتمع آموزش عالی فنی و مهندسی اسفراین، در دادگاه تجدیدنظر تأیید شده است. گزارش ها حاکی از آن است که این دانشجو پس از خروج از کشور، اکنون در ترکیه به سر می برد و نگران بازگردانده شدن به ایران است.
بر اساس رأی تجدیدنظر، شعبه اول دادگاه انقلاب شهرستان بجنورد در دادنامه ای به تاریخ 14 فروردین 1405، علی یاری را به اتهام «تحریک و تشویق دیگران علیه امنیت داخلی کشور در فضای مجازی» به پنج سال حبس تعزیری و به اتهام «فعالیت تبلیغی علیه نظام جمهوری اسلامی» به یک سال حبس محکوم کرده بود. دادگاه تجدیدنظر با رد درخواست نقض حکم، محکومیت پنج سال علی یاری را تأیید کرده است. مجموع محکومیت اولیه او که شش سال حبس بود، پس از رسیدگی در مرحله تجدیدنظر به پنج سال کاهش یافته است و این رأی قطعی اعلام شده است.
دادگاه در استدلال خود به گزارش ضابطان، حضور علی یاری در محل اعتراضات، فیلم برداری او و محتوای تلفن همراهش استناد کرده است. اعتراض مطرح شده در دفاعیات او به تغییر عنوان اتهام نسبت به کیفرخواست نیز با این استدلال رد شده است که تطبیق عنوان اتهامی با عمل انتسابی در اختیار دادگاه است.
گزارش ها نشان می دهند که علی یاری در تاریخ 13 دی 1404 در اسفراین، هنگام فیلم برداری از خشونت نیروهای امنیتی، بازداشت شد و پس از آن ناچار به ترک ایران شده است. همچنین اعلام شده است که سفارت فرانسه از علی یاری برای مصاحبه دعوت کرده، اما ویزای او هنوز صادر نشده است. نگرانی از اخراج از ترکیه و بازگردانده شدن به ایران همچنان وجود دارد.
