On Sunday, January 27, 2025, Shahriar Bayat, born in 1960, a prisoner of conscience and social media activist sentenced to death and held in Evin Prison, is at risk of execution while being denied medical treatment.
Shahriar Bayat suffers from a stomach ulcer, prostate issues suspected to be cancer, large intestine inflammation, and gout. Additionally, he has been denied the right to be sent to specialized medical and dental centers, despite losing several teeth due to decay. This political prisoner has been transferred to the Evin Prison infirmary several times but, due to the lack of medical facilities there, has been returned to the general ward. He has also been denied transfer to a specialized hospital following opposition from the Tehran prosecutor and the security officer handling his case.
A knowledgeable individual reported that Bayat has requested to be sent to the hospital several times, but due to the opposition of the Tehran prosecutor and the security officer, he has been denied medical treatment. During interrogation, Bayat suffered significant mental and physical harm, resulting in chronic headaches, and his eyes sometimes turn red from the pain. Due to the psychological pressures he faces, Bayat has experienced significant weight loss. Additionally, his appeal, submitted to the Supreme Court by his lawyer, remains unresolved, and after numerous follow-ups, the lawyer was informed that reviews are conducted based on the Supreme Court's registration number.
It is worth noting that Shahriar Bayat was arrested by security forces on September 25, 2022, and after being transferred to a security detention center and undergoing interrogation and indictment, he was moved to the Greater Tehran Prison.
As legal proceedings began, the case against Shahriar Bayat, with two indictments, was referred to the Revolutionary Court and Branch 13 of the Criminal Court 1 of Tehran Province, presided over by Saeed Sharafati and Ali Taqian.
After being tried by Saeed Sharafati and Ali Taqian, two advisors of Branch 12 of the Criminal Court 1 of Tehran Province, Bayat was sentenced to death by majority vote for the charges of "insulting the Prophet Muhammad," "insulting Fatimah and other Imams," and "insulting Islamic sanctities."
In the minority opinion, Judge Abolqasem Morad Talab, another advisor of Branch 13 of the Criminal Court 1 of Tehran Province, initially sentenced Bayat for "insulting the Prophet Muhammad" and "insulting Fatimah and Islamic sanctities." However, regarding the charge of "insulting the Prophet," he was sentenced to a lesser punishment. For other charges such as "insulting Fatimah and Fatimah Zahra" and "insulting Islamic sanctities," the court determined that these charges did not fall under the category of "insulting the Prophet" and were considered fifth-degree discretionary offenses. Based on Article 115 of the Islamic Penal Code ratified in 2013 and Article 513 of the Discretionary Punishments Law ratified in 1996, and considering Article 37 of the Islamic Penal Code amended on May 12, 2020, he was sentenced to six months of discretionary imprisonment.

به گزارش حقوق بشر در ایران، امروز یکشنبه ۷ بهمن ماه ۱۴۰۳، شهریار بیات، متولد: ۱۳۳۹، زندانی عقیدتی و فعال فضای مجازی، محکوم به اعدام و محبوس در زندان اوین، در حالی که از حق درمان محروم شده در خطر اجرای حکم اعدام قرار دارد.
براساس این گزارش، شهریار بیات از بیماری زخم معده، مشکلات مرتبط با پروستات«مشکوک به سرطان»، التهاب روده برزگ و نقرس، در رنج است و از سوی دیگر با توجه به اینکه چندی دندان وی بر اثر خرابی از بین رفته از حق اعزام به مرکز تخصصی درمانی و دندانپزشکی هم محروم شده است. این زندانی سیاسی، طی چند مرحله به بهداری زندان اوین منتقل شده اما با توجه به فقدان امکانات درمانی در بهداری آن زندان مجددا به بند عمومی بازگردانده شده و از اعزام وی به بیمارستان تخصصی هم در پی مخالفت دادستان تهران و ضابط امنیتی پرونده اش محروم مامده است.
به نقل از یک فرد مطلع در گفتگو با گزارشگر حقوق بشر در ایران:”چند مرحله آقای بیات در خواست اعزام به بیمارستان کرده اما در پی مخالفت دادستان تهران و ضابط امنیتی پرونده این زندانی سیاسی از حق درمان محروم شده است. با توجه به اینکه آقای بیات، در دوران بازجویی به لحاظ روحی و فیزیکی مورد آسیب های جدی قرار گرفته از سردردخای مضمن هم در رنج است و برخی مواقع از شدت سر درد چشمان وی قرمز می شود. آقای بیات به علت فشارهای روحی ـ روانی که با آنها دست به گریبان است به شدت دچار کاهش وزن شده و از سوی دیگر، درخوسات فرجام خواهی وی هم که توسط وکیل او به دیوان عالی کشور ارسال شده بلاتکلیف مانده و پس از پیگیری های بسیاری به وکیل آقای بیات عنوان شد«که بررسی ها براساس شماره ثبت در دیوان عالی صورت می گیرد.”
لازم به ذکر است، شهریار بیات، در تاریخ ۳ مهر ماه ۱۴۰۱، توسط نیروهای امنیتی، دستگیر و پس از انتقال به بازداشتگاه امنیتی و طی مراحل بازجویی ها و تفهیم اتهام به زندان تهران بزرگ متتقل شد.
با آغاز مراحل دادرسی، پرونده تشکیل شده بر علیه شهریار بیات، با ۲ کیفرخواست به شعبه دادگاه انقلاب و شعبه ۱۳ دادگاه کیفری۱ استان تهران به مسشتاری سعید شرافتی و علی تقیان، ارجاع شد.
شهریار بیات، پس از محاکمه توسط سعید شرافتی و علی تقیان ـ دو مستشاران شعبه ۱۲ دادگاه کیفری ۱ استان تهران در رای اکثریت، از بابت اتهام «سب النبی نسبت به پیامبر اسلام حضرت محمد» و «توهین به حضرت زهرا و سایر معصومین » و «اهانت به مقدسات اسلام» به اعدام محکوم شد.
شهریار بیات، در رای اقلیت هم توسط قاضی ابوالقاسم مرادطلب ـ دیگر مستشار شعبه ۱۳ دادگاه کیفری ۱ استان تهران، از بابت اتهام«سب النبی نسبت به پیامبر اسلام»، و «توهین به حضرت فاطمه و اهانت به مقدسات اسلام» بدوا راجب اتهام «سب النبی» نسبت به پیامبر اسلام، محکوم به سقوط حد محکوم شد در خصوص دیگر عناوین اتهامی از قبیل «توهین به حضرت فاطمه و حضرت زهرا» و نیز «اهانت به مقدسات اسلامی» با توجه به اینکه اتهامات تهامات مذکور به تشخیص این دادگاه از شمول سب النبی خروج موضوعی داشته و از زمره جرائم تعزیری درجه ۵ بود با استناد به مفاد ۱۱۵ از قانون مجازات اسلامی مصوب ۱۳۹۲ و ماده ۵۱۳ قانون تعزیرات مصوب سال ۱۳۷۵ و با رعایت ماده ۳۷ قانون مجازات اسلامی اصلاحی ۱۳۹۹/۰۲/۲۳، به تحمل ۶ ماه حبس تعزیری محکوم شد.
