Abbas Dries and his brother Mohsen Dries were sentenced by the judge of Branch 3 of the Criminal Court 1 of Khuzestan Province to 16 years of discretionary imprisonment.
Fereshteh Tabanian, a judiciary attorney, announced this news on her personal page and explained: "Abbas Dries, in Branch 3 of the Criminal 1 of Khuzestan Province, was sentenced to 14 years of discretionary imprisonment on charges of premeditated murder and carrying and storing weapons. The judge considered the documentary verdict his knowledge and on this basis, out of this amount, 10 years are executable. I objected to this verdict."
This judiciary attorney added in another part of her explanations: "Mohsen Dries was acquitted of the charge of complicity in murder but sentenced to 2 years of discretionary imprisonment on the charge of storing weapons."
The trial session on the charges of Abbas Dries and Mohsen Dries was held on October 21, 2023, in the second part of their legal case for committing premeditated murder by the judge of Branch 3 of the Criminal Court 2 of Ahvaz.
It should be noted that Abbas Dries, previously, for the first part of this case on October 21, 2022, by Ramin Mehmnavaz, the judge of the first branch of the Revolutionary Court of Mahshahr County, was sentenced to execution on charges of waging war through power demonstration with Kalashnikov military weapon, carrying military weapon and shooting with Kalashnikov weapon. The issued verdict against him was exactly confirmed by Branch 39 of the Supreme Court in mid-July 2023, but on July 15, 2023, Fereshteh Tabanian, the defense attorney of Abbas Dries, had announced the registration of a request for a retrial of her client's case in the Supreme Court. After that, the order to stop the execution of Abbas Dries was sent to the first branch of the General and Revolutionary Court of Mahshahr County.
به گزارش حقوق بشر در ایران، طی روزهای اخیر، عباس دریس و برادر وی محسن دریس، توسط قاضی شعبه ۳ دادگاه کیفری ۱ استان خوزستان، به تحمل ۱۶ سال حبس تعزیری محکوم شدند.
فرشته تابانیان، وکیل دادگستری، ضمن اعلام این خبر در صفحه شخصی خود تشریح کرد:”عباس دریس، در شعبه ۳ کیفری ۱ استان خوزستان، به اتهام قتل عمد و حمل و نگهداری اسلحه به ۱۴ سال حبس تعزیری محکوم شد. مستند حکم را قاضی عِلم خود دانست و بر همین اساس، از این مقدار، ۱۰سال قابل اجرا ست. به این حکم اعتراض کردم.”
این وکیل دادگستری در بخش دیگری از توضیحات خود افزود:”محسن دریس، از اتهام معاونت در قتل تبرئه شد ولی به اتهام نگهداری اسلحه به تحمل ۲ سال حبس تعزیری محکوم شد.”
جلسه دادرسی به اتهامات عباس دریس و محسن دریس، در تاریخ ۳۰ مهر ماه ۱۴۰۲، در بخش دوم از پرونده قضایی خود از بابت ارتکاب قتل عمد توسط قاضی شعیه ۳ دادگاه کیفری۲ اهواز، محاکمه شده بودند.
لازم به اشاره است، عباس دریس، پیش از این و از بابت بخش اول همین پرونده در تاریخ ۳۰ مهر ماه ۱۴۰۱، توسط رامین مهمان نواز، قاضی شعبه اول دادگاه انقلاب شهرستان ماهشهر به اتهام محاربه از طریق قدرت نمایی با اسلحه جنگی کلاشینکف و حمل سلاح جنگی و تیراندازی با اسلحه کلاشینکف به اعدام محکوم شد و حکم صادره بر علیه وی اواسط تیر ماه ۱۴۰۲، در شعبه ۳۹ دیوان عالی کشور عینا تائید گردید اما در تاریخ ۲۴ تیر ماه ۱۴۰۲، فرشته تابانیان، وکیل مدافع عباس دریس، از ثبت درخواست اعاده دادرسی به پرونده موکل خود در دیوان عالی کشور خبر داده بود و پس از آن دستور توقف اجرای حکم اعدام عباس دریس، به شعبه اول اجرای احکام دادسرای عمومی و انقلاب شهرستان ماهشهر، ارسال شد.
