The judiciary claimed that he was an active participant in the protests and was involved in incidents on 8 January 2026 in the Tabarsi area of Mashhad, which led to the deaths of four security personnel.

وی در جریان اعتراضات دی ماه ۱۴۰۴ در مشهد بازداشت شده بود. قوه قضاییه مدعی شده است که او از فعالان و عوامل میدانی اعتراضات دی ماه ۱۴۰۴ بوده و در وقایع روز ۱۸ دی ماه در محدوده طبرسی مشهد، در اقداماتی که به کشته شدن چهار تن از نیروهای امنیتی منجر شد، نقش داشته است.
نیروهای امنیتی و انتظامی در جریان و پس از اعتراضات شماری از شهروندان را بازداشت کردند و برخی دیگر نیز پس از بررسی تصاویر دوربین های شهری بازداشت شدند. علی همتی از جمله افرادی بود که در همین ارتباط بازداشت و پرونده اش به مراجع قضایی ارجاع شد.
