Mahmoud Taravat Roi, Masoud Ahmadian, and Nazanin Salari, judicial attorneys, will be tried by the judge of the first branch of the Revolutionary Court and the branch of the Criminal Court 2 of Shiraz, the center of Fars province, for a judicial case in two sections.
Quoting an informed person in an interview with the Human Rights reporter in Iran: "In the coming days, Mr. Mahmoud Taravat Rui, Masoud Ahmadian, and Ms. Nazanin Salari, three of the judicial attorneys in their first case, will be tried by Judge Mahmoud Sadati in the first branch of the Shiraz Revolutionary Court for charges (cooperation with the hostile government), (assembly and collusion against national security) and (propaganda activities against the system) and in another section of the same case, they will also be tried by the judge of the branch of the Criminal Court 2 of Shiraz."
This informed person further noted: "This summons is related to a case that was formed in 1399 with charges (assembly and collusion against national security), (propaganda activities against the system) and (cooperation with the hostile government) against Masoud Ahmadian, Nazanin Salari, and Mahmoud Taravat Rui, but the important point is the legal objections that had caused this case to be returned to the prosecutor in 1401 from the court under the title of defect in judicial investigations, and the same objections remain in the indictment and have not changed."
This informed source, explaining the reason for the formation of this case against the three judicial attorneys, added: "Interviewing with foreign media, holding and participating in workshops and foreign conferences on children and women, trying to change laws in the field of children and women through communication with officials and decision-making and law-making centers (including the Vice Presidency for Women and Family Affairs and members of the parliament), providing free counseling to women at risk and violence, advocacy for some ideological and political cases, awareness-raising about violence against women and the 16 days of activism against gender-based violence were among the reasons."
It should be noted that Mahmoud Taravat Rui, Masoud Ahmadian, and Nazanin Salari, were summoned in November 1399 according to a notice received from the interrogator of branch 10 of the general and revolutionary court of Shiraz to the supervision and follow-up department of the Ministry of Intelligence in that city. This summons lasted for 45 days and during this time, it was spent with 12 stages of long-term interrogations for each of these judicial attorneys, but no charges were brought against them, but after the end of the interrogations, the case of these people was sent to the prosecutor and in the summer of 1400, these three judicial attorneys were summoned by the interrogator of branch 10 of the general and revolutionary court of Shiraz, charged, and finally each was released on a bail of one billion Tomans.
Also, on May 8, 1401, the defendants of this case were summoned by the prosecutor of Shiraz in branch 10 of the city's court, to appear in court for charges (propaganda against the system), (assembly and collusion to commit a crime against national security) and (communication and cooperation with hostile governments).
Nazanin Salari and Mahmoud Taravat Rui, on November 1, 1401, along with Bahar Sahraeian, were arrested by the agents of the Ministry of Intelligence in the city of Shiraz and were released after a while.
According to the ruling issued by Branch 1 of the Shiraz Revolutionary Court, she was sentenced to two years’ imprisonment on the charge of assembly and collusion with the intent to commit crimes against national security, and one year for propaganda against the state.
Under the application of the law on aggregation of sentences (Article 134), only the most severe punishment—two years of discretionary imprisonment—will be enforceable. According to Emtedad, the court also acquitted her of the charge of cooperation with a hostile state.
In addition, alongside the prison sentence, she has been sentenced to a supplementary punishment of a two-year ban on leaving the country, along with the revocation of her passport.
It is also worth noting that, in addition to this case, this lawyer is facing parallel proceedings in Branch 112 of the Shiraz Criminal Court Two on other allegations, including encouraging corruption and prostitution and appearing in public places without the mandatory hijab. Legal action against her is still ongoing.
به گزارش حقوق بشر در ایران، محمود طراوت روی، مسعود احمدیان و نازنین سالاری، وکلای دادگستری، در روزهای آینده توسط قاضی شعبه اول دادگاه انقلاب و شعبه دادگاه کیفری ۲ شیراز در یک پرونده قضایی محاکمه خواهند شد.
گزارش شده است که این وکلا در پرونده اول خود به اتهامات همکاری با دولت های متخاصم، اجتماع و تبانی علیه امنیت کشور و فعالیت تبلیغی علیه نظام محاکمه خواهند شد. همچنین در بخش دیگر از همین پرونده نیز توسط قاضی شعبه دادگاه کیفری ۲ شیراز مورد محاکمه قرار خواهند گرفت.
این پرونده در سال ۱۳۹۹ با اتهامات اجتماع و تبانی علیه امنیت ملی، فعالیت تبلیغی علیه نظام و همکاری با دولت های متخاصم علیه این وکلا تشکیل شده بود. در سال ۱۴۰۱، این پرونده به دلیل نقص در تحقیقات قضایی به دادسرا عودت داده شد و ایرادات حقوقی آن همچنان در کیفرخواست باقی مانده است.
علت تشکیل این پرونده علیه این وکلا، مصاحبه با رسانه های خارج از کشور، برگزاری و شرکت در کارگاه ها و کنفرانس های خارجی با موضوع کودکان و زنان، تلاش برای تغییر قوانین در حوزه کودکان و زنان، مشاوره رایگان به زنان در معرض تهدید و خشونت و وکالت برخی پرونده های عقیدتی و سیاسی اعلام شده است.
محمود طراوت روی، مسعود احمدیان و نازنین سالاری در آبان ماه ۱۳۹۹ به اداره نظارت و پیگیری وزارت اطلاعات در شیراز احضار شدند و این احضار به مدت ۴۵ روز به طول انجامید. در این مدت، هر یک از این وکلا با ۱۲ مرحله بازجویی طولانی مدت مواجه شدند، اما هیچ اتهامی به آنها تفهیم نشد. پس از اتمام بازجویی ها، پرونده این افراد به دادسرا ارسال و در تابستان سال ۱۴۰۰، این وکلا احضار و تفهیم اتهام شدند و هر یک با تودیع وثیقه هایی به مبلغ ۱ میلیارد تومان آزاد شدند.
در تاریخ ۱۸ اردیبهشت ۱۴۰۱، برای متهمان این پرونده از سوی دادستان شیراز قرار جلب به دادرسی به اتهامات تبلیغ علیه نظام، اجتماع و تبانی برای ارتکاب جرم علیه امنیت ملی و ارتباط و همکاری با دولت های متخاصم ابلاغ شد.
نازنین سالاری و محمود طراوت روی در تاریخ ۱۰ آبان ماه ۱۴۰۱ به همراه بهار صحراییان توسط ماموران وزارت اطلاعات در شیراز بازداشت و پس از مدتی آزاد شدند.
وکیل دادگستری و فعالان شناخته شده حقوق زنان و کودکان ساکن شیراز، توسط شعبه اول دادگاه انقلاب این شهر به تحمل سه سال حبس و مجازات های تکمیلی محکوم شد. وی توسط شعبه یکم دادگاه انقلاب شیراز از بابت اتهام اجتماع و تبانی به قصد انجام جرم علیه امنیت کشور به دو سال حبس و از بابت اتهام فعالیت تبلیغی علیه نظام به یک سال حبس محکوم شده است. با اعمال قانون تجمیع احکام (ماده ۱۳۴)، مجازات اشد یعنی دو سال حبس تعزیری قابل اجرا خواهد بود. به نوشته امتداد، دادگاه همچنین وی از اتهام همکاری با دولت متخاصم تبرئه کرده است. همچنین، علاوه بر حکم حبس، به عنوان مجازات تکمیلی به دو سال ممنوعیت از خروج از کشور همراه با ابطال گذرنامه محکوم گردیده است. لازم به ذکر است که این وکیل دادگستری علاوه بر این پرونده، در پرونده ای موازی در شعبه ۱۱۲ دادگاه کیفری دو شیراز با اتهامات ادعایی دیگری نظیر تشویق مردم به فساد و فحشا و حضور در اماکن عمومی بدون حجاب شرعی مواجه است و روند برخورد با وی کماکان ادامه دارد.
