Majid Eskandari, a young man from Zibashahr, Qazvin, is scheduled to appear in Branch 3 of the Revolutionary Court in Qazvin on 18 October 2026 to face charges of "conspiracy and collusion." He is currently imprisoned in Mashhad on a new charge of "moharebeh."
Eskandari had previously been released on bail in the Qazvin case, but after being re-arrested by the Intelligence Department of Mashhad, he is now held in Ward 5 of Mashhad Prison, which houses inmates with mental health issues, under poor conditions.
His physical and mental health has been reported as deteriorating due to the conditions in the ward and lack of access to adequate medical facilities.
Given that his main case is open in Branch 3 of the Revolutionary Court in Qazvin, which is considered the competent authority, the new charge should also be referred to the same court. However, the investigator in Branch 901 of the Koohe Sanghi Prosecutor's Office in Mashhad has refused to transfer the case, leading to legal complications and uncertainty in the proceedings.
The detention of a suspect in a ward for mental health patients without a final ruling and prior to a complete judicial review has been described as a violation of fair trial principles and humane treatment of detainees.
مجید اسکندری، جوان اهل زیباشهر قزوین، در تاریخ ۲۶ مهرماه ۱۴۰۴ باید در شعبه سوم دادگاه انقلاب قزوین حاضر شود تا به اتهام «اجتماع و تبانی» رسیدگی شود. او هم اکنون با اتهام جدید «محاربه» در زندان مشهد محبوس است.
اسکندری پیش تر در پرونده قزوین با قرار وثیقه آزاد شده بود، اما پس از بازداشت مجدد توسط اداره اطلاعات مشهد، اکنون در بند ۵ زندان مشهد، که محل نگهداری زندانیان اعصاب و روان است، تحت شرایط نامناسب نگهداری می شود.
وضعیت جسمی و روحی او به دلیل شرایط بند و عدم دسترسی به امکانات درمانی مناسب، وخیم توصیف شده است.
با توجه به اینکه پرونده اصلی او در شعبه سوم دادگاه انقلاب قزوین مفتوح است و آن مرجع «صالح و مقدم» محسوب می شود، رسیدگی به اتهام جدید نیز باید به همان مرجع ارجاع شود. با این حال، بازپرس شعبه ۹۰۱ دادسرای کوه سنگی مشهد از انتقال پرونده خودداری کرده که این امر باعث تداخل و بلاتکلیفی حقوقی در روند رسیدگی شده است.
نگهداری یک متهم در بند بیماران اعصاب و روان بدون حکم قطعی و پیش از رسیدگی کامل قضایی، مصداق نقض اصول دادرسی عادلانه و رفتار انسانی با بازداشت شدگان توصیف شده است.
